한미FTA반대! 국제NGO공동성명 ========================================================= 발 신 : 이하 연명단체 수 신 : 각 언론사 사회부, 보건의료 및 지적재산권 담당기자 제 목 : [한국&국제NGO 공동성명] 전세계 민중 건강권의 장애물이 되는 한미FTA 반대한다 날 짜 : 2006. 6. 22 문 의 : – 김정우 (정보공유연대 IPLeft, 진보네트워크센터 / 02-717-9551) – 변혜진 (건강권실현을위한보건의료단체연합 / 02-3675-1987) ========================================================= 1. 안녕하십니까? 2. 신자유주의라는 이름아래 전지구적으로 진행이 되고 있는 다자간, 양자간 자유무역협정(FTA)는 국민들의 의약품에 대한 접근권을 파괴하고, 보건의료체계를 상업화와 사유화와 함께 공공정책을 제한할 것입니다. 3. 특히 한미 자유무역협정(FTA)은 의약품에 대한 특허권 등 지적재산권을 강화하고, 보건체계를 비롯한 공공서비스의 사유화와 상업화를 촉진하는 등 미 제약산업의 이익을 보장하는 대신, 공중보건과 민중의 건강권을 해칠 수 있는 조항들을 다수 포함하고 있습니다. 4. 이에 한국의 인권시민사회단체, 보건의료 단체들은 국제NGO들과 공동으로 한미FTA를 반대하는 성명서를 발표합니다. 5. 많은 언론사들의 자세한 보도 부탁드립니다. 6. 감사합니다. ========================================================= [한미FTA반대! 국제NGO공동성명] 전세계 민중 건강권의 장애물이 되는 한미 FTA에 반대한다 민중의 건강권이 심각한 도전에 직면하고 있다. 오늘 우리는 신자유주의의 이름아래 전구적으로 민중의 건강권을 저해하는 정부들과 국제기구들의 움직임을 목격하고 있다. WTO나 양국간, 지역간 FTA 협정 등의 소위 ‘자유무역’이라는 세계화의 흐름은 의약품 접근권에 대한 제한, 보건의료체계의 상업화와 사유화, 물의 상품화, 식품안전을 위한 노력에 대한 방해, 쾌적한 환경에 대한 침해 등의 현상을 낳고 있다. 이는 지구적으로 이루어지고 있는, 보다 건강한 세계와 환경을 위한 노력에 큰 걸림돌이 되고 있다. 한미 FTA는 기업의 이익을 공중보건보다 앞에 두는, 민중건강권을 저해하는 조항들을 포함하고 있고, 건강권에 전지구적으로 장애가 되므로 우리는 한미 FTA에 반대한다. 1. FTA는 보건체계를 비롯한 공공서비스의 사유화와 상업화를 촉진한다. 우리는 모든 사람이 예방, 치료, 재활 등의 의료서비스를 필요에 따라 이용할 수 있는 권리가 있다고 믿는다. 지유무역협정을 통해 기존의 의료서비스를 상업화하고 공공 의료기관을 사유화하는 것은 민중의 의료 이용에 대한 권리를 제한한다. 영리병원의 허용을 촉진하고 사적 의료보험에 대한 규제를 완화하여 공공적이고 필수적인 국가의료보장 시스템을 마모시키고 의료의 상업화를 촉진시키는 것은 민중의 의료접근권을 제한하는 것이다. 우리는 이와같이 의료의 상업화를 촉진시키고 보건의료제도를 약화시키는 한미 FTA에 반대한다. 2. TRIPS 플러스 조항들은 의약품 접근권을 심각하게 저해한다. 모든 국가는 국민에게 필수적이며 도움이 되는 의약품을 필요에 따라 적절한 가격에 사용할 수 있도록 보장할 의무가 있다. FTA는 특허와 지적재산권에 대한 보장을 강화하는 다양한 장치로 민중의 의약품 접근을 심각하게 저해한다. 의약품인정기관과 특허기관 간의 연계, 특허심사기간만큼의 특허기간 연장, 자료독점권의 인정, 새로운 약효에 대한 새로운 특허 인정 등을 통해 의약품 특허기간의 연장을 추구하는 것, 그리고 특허권의 강제실시 조건을 제한하고 병행수입을 금지하는 것은 의약품접근권을 심각하게 침해하는 것이다. 또한 우리는 자유무역협정을 통해 선진 7개국의 평균약값을 강제하는 등의 의약품 가격을 높이려는 시도들에 대해 반대한다. 우리는 “공중보건과 TRIPS에 관한 도하선언”에 반하여 강제실시나 병행수입의 범위를 제한하는 어떠한 시도에도 반대한다. 3. FTA는 물과 식품의 안전을 위협한다. 우리는 물이 상품이 아니라 누구나 접근할 수 있는 인간의 권리가 되어야 한다고 믿는다. 또한 무역에 있어서 식품의 안전은 최우선적으로 고려되어야 하며, 기업의 이익이 식품안전보다 우선시되어서는 안된다. 우리는 한미 FTA의 사전 조건으로 광우병으로부터 전적으로 안전하다고 평가될 수 없는 쇠고기가 무역협정의 장애물로 취급되어 충분한 검토 없이 수입이 재개되고 있는 현실에 우려를 표명한다. 그러한 결정은 독립적인 보건학적, 의학적 판단에 근거를 두고 내려져야 한다. SPS(위생 및 식물위생 조치) 나 TBT(무역에 대한 기술장벽)에 대한 협정은 식품에 대한 민중의 안전에 반해 수출을 촉진시키는 방향으로 악용되어서는 안된다. 우리는 물에 대한 사유화를 촉진시키고, SPS, TBT 협정을 식품안전을 저해하는 형태로 강화시키며, 정치적인 판단으로 광우병으로부터 안전하지 않은 쇠고기의 수입을 결정하게 하는 한미 FTA에 반대한다. 4. 기업-정부 중재제도는 민중의 건강권과 사회 공공의 이익을 심각하게 침해할 수 있다. 우리는 기업-정부중재제도(investor-government claims)가 민중의 건강권과 안전한 환경에 대한 권리 및 사회의 공공제도를 심각하게 침해하는 사례를 많이 보아왔다. NAFTA의 기업정부 중재제도는, 에틸사나 메탈클라드사의 정부제소에서 볼 수 있듯, 기업의 이익을 위해 공공의 건강을 지키는 제도가 파괴될 수 있음을 보여주었다. 또한 기업중재제도는 캐나다의 뉴 브룬스윅주의 예에서처럼 공중보건을 위한 제도의 도입을 저해할 수 있다. 따라서 우리는 양국 정부가 동시에 기업-정부 중재제도를 협정에 포함하려 추진하고 있는 한미 FTA에 반대한다. 어떤 국제협정이나 지역간, 양국간 무역협정 도는 투자협정도 민중의 건강을 침해하는 조항을 포함해서는 안된다. 따라서 우리는 앞에 열거한 바와 같은 민중의 건강권을 침해하는 여러 가지 독소조항을 포함하는 한미 FTA가 민중들의 건강권을 위한 지구적인 운동에 장애가 될 것으로 판단한다. 이에 우리는 한미 FTA에 반대하며, 전세계의 사회단체들과 개인들이 한미 FTA에 반대하는 우리의 운동에 동참해 줄 것을 호소한다. 2006년 6월 22일 의약품접근권을 위한 국제NGO 공동 연명 (아래 단체 연명 참고) □Joint Statement on KORUS FTA We say NO to FTA, which threatens people’s health right People’s health is under threat. Neo-liberal globalization is the keyword explaining the current global political and economic system. Its policies and orders, implemented through multinational as well as bilateral or regional trade agreements, deterioratepublic interest and deprive the people of their rights to access to public service in the name of Free trade. FTA aims to promote privatization and commercialization of essential services such as health care, education, culture, electricity, water, and every aspects of life. As a result, it restricts access to medicine and threatens food security and safe environment. The proposed KORUS FTA contains provisions that put profit of transnational corporations (TNCs) ahead of people’s health right. These are the reasons why we say No to KORUS FTA. 1. FTA facilitates privatization and commercialization of public services including healthcare system We believe that everyone has the right to health service such as prevention, treatment and rehabilitation based on one’s needs. Commercialization of health service and privatization of public health facilities restrict people’s access to proper health care. Approving profit hospitals and private health insurance system undermines the national healthcare system which has been mandatory in Korea. We oppose the KORUS FTA as it undermines the healthcare system as public goods. 2. TRIPS plus provisions seriously restrict people’s access to medicine Every nation is responsible to ensure its people to access medicine at affordable price. FTAs seriously block people’s access to medicine by forcing various measures to strengthen patent and intellectual property protections on medicine. For instance, linkage between patent and drug approval, patent term extension for examination delay, exclusive right on drug approval data, expanding patentable subject matter, limiting the circumstances under which compulsory license may be issued, and prohibiting parallel import would restrict the entry of generic competitors and undermine the ability to access to medicine at affordable price. We are also concerned of other measures such as A-7 average price for innovative drug used to raise the drug price and serve to benefit patent owners. We demand that any measures that restrict compulsory licensing and parallel import against the spirit of Doha Declaration on TRIPS Agreement and Public Health should be stopped. 3. FTA threatens the safety of food and water We believe that water is a common resource that everyone has the right to get access. Also, safety should be the priority concern in food trading. We worry that the decision to restart import of beef that is not safe from mad cow disease is made by Korean government simply because beef was considered as a barrier to FTA talk. It should have been based on medical and epidemiologic evidence provided by independent party. The agreements on SPS(Sanitary and Phytosanitary Measures) & TBT(Technical Barriers to Trade) should not be used as measures to promote export against people’s health. Thus we oppose KORUS FTA that privatize water; reach agreements on SPS & TBT that threatens health; and decide import of beef on political basis. 4. The investor-to-government claim system can infringe on government’s duty and right to protect public goods. We have witnessed many cases that investor-to-government claim system seriously infringes on people’s right to health, safe environment, and public security system. Under NAFTA, Ethyl and UPS claims against government showed that public health policy could be ruined for the profit of corporations. We also know the case that the attempt of New Brunswick state government to introduce a policy to improve public health system was set back by an investor’s claim. Therefore we oppose the KORUS FTA that contains provisions of investor-to-government claim system. Any international agreement, bilateral and regional trade agreements should not contain provisions that adversely affect people’s health status. We conclude that KORUS FTA would infringe on people’s health right. Also we conclude that it will be a barrier to the global movement to enforce people’s health right.
