위조방지무역협정(ACTA)에 대한 긴급 성명

이 성명은 2010616-18, 아메리칸 대학 워싱턴 법대에 모인 6개 대륙에서 온 90명이 넘는 학자, 전문가, 공익단체 대표들이 가진 회의에서 합의된 결론을 바탕으로 한 것이다. 아메리칸 대학의 ‘정보 정의와 지적재산권에 대한 프로그램(PIJIP: Program on Information Justice and Intellectual Property)’가 주최한 이 회의는 20104월 처음 공개된 위조방지무역협정의 공식 문안을 분석하기 위해 소집되었다. 협상 당사국들은 전례없이 폐쇄적으로 진행된 협상 절차에 대한 공공의 비판과 협상 내용을 둘러싼 불안이 확산되고 나서야 이 협정 문안을 공개하였다(웰링턴 선언, 투명성과 ACTA 협상 진행상황에 대한 EU 결의안 참조).

 

우리는 위조방지무역협정(ACTA: Anti-Couterfeiting Trade Agreement) 협정문 초안의 내용이 수많은 공공의 이익을 위협하며, 여기에는 협상 대표들이 그렇지 않다고 부인한 것들까지 포함된다는 점을 알게 되었다.

 

 ● 협상대표들은 ACTA가 시민들의 기본권과 자유를 침해하지 않을 것이라고 주장한다. 그러나 ACTA는 시민들의 기본권과 자유를 침해할 것이다.

 ● 협상대표들은 ACTAWTO 무역관련 지적재산권 협정과 일치한다고 주장하지만 실제로는 그렇지 않다.

 ● 협상대표들은 ACTA가 합법적인 제네릭 의약품의 국경 검색을 증가시키거나 제네릭 의약품의 합법적인 국경간 이동을 제약하지 않을 것이라고 주장한다. 그러나 그럴 것이다.

 ● 협상대표들은 ACTA가 사람들의 인터넷 접속을 차단하는 “누진적 대응”(역자 주: 저작권 삼진아웃제)을 요구하지 않을 것이라고 주장한다. 그러나 이 협정은 저작권 삼진아웃제를 강력하게 권장하고 있다.

 

ACTA 는 심각하게 잘못된 과정으로 협상되고 있으며 이로부터 예견했던 결함을 그대로 갖고 있다. 이 협상은 세관 당국들의 협력을 모색하려는 비교적 단순한 제안에서 시작되었으나 전 지구적 차원의 지적재산권 보유 기업들이 이 협상을 전략적으로 악용하면서 이제는 광범위하고 복잡한 새로운 지적재산권 규범과 인터넷 규제로 변형되었다. 그 결과 세계 경제와 공익을 보호/증진할 정부의 권한에 암울한 결과를 초래할 것이다.

 

이러한 결과를 초래할 정도로 중요하며 광범위한 협상은 투명하고 공개적이고, 언론 보도가 보장되고, 협상 문안에 대한 계속적으로 열린 접근이 보장된 광범위하고 의미있는 협의적 절차에 기반해야 하며, 모든 범위의 공익에 대한 우려를 반영해야만 한다. 그러나 아래에 상세히 설명한 것처럼, 이 문안은 이러한 기준을 충족하지 못하고 있다. 우리가 접근할 수 없는 제안들을 기초로 협상이 더 진행되었다는 점을 인식하면서, 우리는 20104월에 공개된 초안을 공정한 입장에서 분석한 결과, 세계적 차원의 공공정책과 관련된 최소한 7개 핵심 영역에서, ACTA가 공공의 이익을 저해한다는 결론에 도달했다.

 

기본권과 자유

 

ACTA 는 건강권, 프라이버시, 개인정보의 보호, 표현의 자유, 교육, 공정한 재판과 무죄추정의 원칙을 포함한 법적 절차의 권리, 문화적 참여 등 국내에서 그리고 국제적으로 보호받는 인권을 포함한 기본권과 자유의 향유를 위축시킨다.

 

인터넷

 

ACTA,

 ● 인터넷 서비스 제공자가 가입자의 행위에 책임을 지도록 하고, 감시 정책을 채택해야만 면책을 받을 수 있도록 하며, 협상국들로 하여금 서비스 제공자와 (지재권) 권리 보유자 사이의 협력을 촉진하도록 함으로써, 인터넷 서비스 제공자가, 이용자들의 인터넷 접속을 차단하는 것을 포함하여, 인터넷 이용자들의 행위를 감시하도록 조장할 것이다.

 ● 법원의 감독이나 적법 절차 없이 사기업들에 의한 인터넷 감시를 조장하고, 인터넷 접속 차단이 일종의 처벌처럼 이루어지게 할 우려가 있다.

 ● 혁신과 경쟁, 자유 (자유를 존중하는) 소프트웨어, 열린 접근 사업모델, 상호호환성, 이용자 권리의 향유, 이용자 선택권을 위협할 반 우회조항(역자 주: 암호화와 같은 기술적 보호 조치를 깨는 행위도 저작권 침해로 규제하는 조항)을 지구적으로 확대할 것이다.

 

의약품에 대한 접근

 

ACTA는 적정한 가격의 의약품에 대한 접근을 위협할 것이다.

 ● 의약품이 생산국과 수입국의 법률을 침해하지 않을 때조차도, 경유 국가에서 세관 당국이 해당 의약품을 압류할 수 있도록 허가함.

 ● 자신도 모르는 사이에 의약품의 원료 물질이 지재권 침해에 이용된 경우, 의약품의 원료 물질 공급자를 지재권 침해 행위에 연루된 것으로 규정함.

 ● 기술 혁신에 대한 포상금 제도(가령 연구/개발 비용과 제품의 시장 가격의 연결 고리를 단절하려는 공공 정책), 법원이 판결을 통해 부여하는 강제실시, 또는 특허발명의 정부 사용과 같은 주로 특허 제도에 활용될 수 있는 공공 정책의 일환으로서 권리침해의 금지명령을 유연화하려는 정책 수단의 제약.

 ● 협정문의 적용 범위를 특허로 확대(이는 위조 상품 근절과는 관련이 없는 영역임).

 

지적재산권법의 범위와 속성

 

ACTA는 다음과 같이 (지재권) 소유자와 이용자의 권리/이익의 기본적 균형을 왜곡할 것이다.

 ● 권리 보유자를 위한 매우 구체적인 권리나 구제책은 도입하면서, 이에 상응하는 이용자를 위한 예외, 제한, 절차적 면책에 대한 세부 내용은 없음.

 ● (지재권) 소유자의 요구만 배려하는 방식으로, 공공 기관이나 사적 중개자에게 (지재권) 집행의 부담을 이전.

 ● 손해배상액을 정해진 공식에 따라 평가하도록 함으로써 실제로 입증된 피해나 이익과는 관련성이 없는 손해배상책임을 지도록 함.

 ● 권리 보유자에 의한 집행 절차의 남용을 강력히 제약할 수 있는 정책의 부재.

 ● 정부의 유연성을 제한하고 혁신을 제약하며 녹색 기술의 개발과 확산을 더디게 할 수 있는, 경직된 금지명령, 손해배상, 강화된 민형사 집행조항 포함.

 ● 공공의 이익을 위한 권리예외 조항, 예를 들면 승인(authorization)에 의한 저작물의 복제를 허용하는 보통법 국가의 권리예외 조치의 지속이나 개발의 제약.

 

국제 무역

 

ACTA는 필수 상품의 수입과 수출에 의존적인 개발도상국에 편향적으로 피해를 주는 방식으로 (무역) 장벽을 높일 것이다. 특히, ACTA,

 ● 세관 당국으로서는 판단하기 불가능한 복잡한 법률 문제와 사실관계가 얽혀있는 특허 침해가 주장되는 물품을 포함하여, 지재권 침해물로 “의심되는” 광범위한 범위의 물품에 대해 ‘직권에 의한’ 국경 검색과 압류 조치, 그리고 환적 물품에 대한 국경 검색 및 압류 조치를 확대하고 있다.

 

국제법과 기구

 

ACTA는 직간접적으로 기존의 국제법 및 절차와 많은 점에서 충돌한다. 특히, ACTA는 다음과 같은 조항을 포함하고 있다.

 ● “수입국”(TRIPS 52) 대신에 “절차가 진행되는 당사국의” 법률에 기반하여 압류를 허용함으로써 세계무역기구 무역관련 지적재산권협정(WTO TRIPS)과 직접적으로 충돌하며, 남용에 대한 핵심적인 보호(41.1, 48.1, 48.2, 50.3, 53.1), 공공의 이익을 증진하기 위한 유연성(TRIPS 44.2), 집행 조치의 비례성에 대한 요구(46,47), (지재권) 소유자, 소비자, 전체 사회의 이익 사이의 균형을 도모하는 조항(TRIPS 7, 8, 41.2)을 완전히 보장하고 포함하지 못함으로써 TRIPS와 간접적으로 충돌한다.

 ● 의약품에 대한 접근을 증진하기 위해 TRIPS의 유연성을 “최대한으로” 이용할 수 있는국가의 권한을 제한함으로써 ‘TRIPS 협정과 공중 보건에 대한 WTO 도하 선언’ 및 세계보건기구 총회(World Health Assembly)의 결의문 61.21과 충돌한다.

 ● 세계지적재산권기구(WIPO)의 개발 의제, 특히 “보다 넓은 사회적 이익과 특히 개발-지향적인 맥락에서 지적재산권 집행을 다루려는” 권고안 45를 훼손한다.

 ● 새롭고 불필요한 국제 행정기구를 창설함으로써 WIPO WTO의 역할을 약화시킨다.

 

민주적인 절차

 

ACTA는 다음과 같이 전통적이고 헌법에 의해 위임된 법 제정 절차를 변경한다.

 ● 논란이 있고 문제가 많은 집행 관행의 전파와 고착화, 그리고 기술 혹은 정책의 변화에 대응한 향후의 법제 개선의 제한.

 ● 입법 과정없이 많은 국가에서 지적재산권 법의 근본적인 변화 요구.

 

ACTA 협상의 절차는 근본적으로 잘못되어 있다. 특히, 이 협상은,

 ● 많은 다자간 협상처럼 공개적으로 수행되지 않았다.

 ● 이 협정이 해결하고자 하는 공공 정책상의 문제가 존재한다는 점을 보여주는 증거가 제시되지 않았다.

 ● 몇몇 이해당사자에게만 비공개를 전제로 의견 제시가 허용되었고, 자주 바뀌는 협상 문안에 대한 접근을 허용하지 않은 채 협상이 진행되었다.

 ● 이해당사자들(특히 시민사회)의 균형있는 대표성이 부족하다.
