위 내용을 글짜 그대로 해석하면 사람과 다른 동물 세포의 배아 간세포를
썩어서 키메라를 만들 수 있다고 충분히 볼 수 있겠네요.
저도 이런 내용이 그렇게 격분할 만큼의 내용은 아니라고 생각합니다.
이 정도의 내용은 생명공학하는 사람들에게는 엽기적으로 보이기는 커녕
실현성을 아직 입증하지 못한 단계의 추정에 불과할 뿐이니까요.
실제로 키메라를 만들어서 그것을 특허출원했다면 또 모를까…
이런 표현만으로 엄청난 윤리적 문제라고 제기하기는 그린피스의
용기가 가상하다고 생각이 되네요.
저는 생명윤리와 특허허용 사이에서 우리가 어떤 원칙을 가질 수
있는가라는 문제에 부딪히면 늘상 혼란을 겪게 됩니다. 특허가

inhibitory factor (LIF)을 배지에 넣으면 maintain에도 좋고
pluripotential phenotype을 유지하는데도 좋다는 것 같군요.
그런데 명세서의 내용 중 이런게 있습니다.

말씀하신 유럽 특허에 대응하는 미국 특허 (US5166065)의 클레임
입니다. 아마도 유럽특허도 동일하거나 최소한 아주 유사한 특허청구범위??
특허되었을 겁니다.
청구항 1을 보면 시험관내의 포유동물 배(embryo) 배아 간세포를 분리하는
방법을 청구한 것이어서, 인간과 다른 포유동물의 잡종을 만들 수 있다는
내용을 특허청구한 것은 아닌 것 같습니다.
다만 명세서 가운데 그런 내용이 있을 수는 있겠지요.
아직 살펴보지는 않았는데, 클레임 뒤에 명세서 내용도 첨부했습니다.

Greenpeace에 의하면 Amrad라는 Australian회사가 ‘chimaeric'(mixed-
species) animal(아마도 최악의 경우 human+other)을 만들 수도 있는 내용을 포
함하는 특허를 작년에 EPO로부터 받았다는건데…
정말 그런지 European patent 380646를 한번 찾아볼 필요가 있겠군요.

1. 인터넷 서비스 제공자의 책임문제
